These terms apply to cynthiawinter.com and to anything bought through it. Placing an order means you accept them.

WHO YOU ARE BUYING FROM

This site is owned and operated by Cynthia Winter, a sole proprietor, of 4 Nadia Circle, Troy, New York 12180. Every order is fulfilled by Cynthia herself.

WHAT IS SOLD HERE

Two things: the poetry collection Bittersweet: The Certainty of Change, in hardcover and paperback, and limited-edition giclée prints of Cynthia's artwork.

Original artwork is not sold through this site. Originals are available by contacting Cynthia directly, and any sale of an original is arranged between you and her outside these terms.

PLACING AN ORDER

An order becomes a contract when Cynthia accepts it, not when you submit it. In the rare case an order can't be filled, you'll be told and refunded in full.

Prints are limited to two of each per order. If you would like more than two, write to Cynthia.

Signed copies of the book can carry a handwritten dedication. Cynthia writes each one by hand and can't change it afterward, so please check the spelling before you order.

PRICES AND PAYMENT

Prices are in US dollars. Art prints ship free within the United States. Books ship for a flat $5 per order, however many books are in it. Sales tax is calculated at checkout where it applies.

Payment is taken at checkout through Squarespace. Card details go to the payment processor and are never held by Cynthia.

SHIPPING AND DELIVERY

Orders ship within five business days, signed copies included.

Prints go by USPS Priority Mail with tracking, and typically arrive in one to three business days after shipping. Books go by standard USPS ground service without tracking, and typically arrive in two to five business days.

Prints and books never travel in the same box. If you order both, they are handled as two separate orders: you'll receive a confirmation for each, and they ship as separate packages that may arrive on different days.

Delivery estimates are the carrier's, not Cynthia's, and aren't guaranteed.

Orders ship within the United States only.

IF SOMETHING ARRIVES DAMAGED

Write to Cynthia within thirty days of delivery with photographs of the item and of the packaging it arrived in. Please keep both until the claim is settled.

A damaged print is replaced where one remains in the edition, and refunded where the edition has sold out. A damaged or missing book is replaced.

Occasionally Cynthia may ask for an item to be sent back. She covers the postage when she does.

IF AN ORDER DOESN'T ARRIVE

Books ship without tracking, so an order that hasn't turned up within fourteen business days is treated as lost and replaced. Write to Cynthia.

For a print, the tracking number in your shipping email is the place to start. If it shows delivered and the package isn't there, write to Cynthia and she'll work it out with you.

RETURNS

Books in their original packaging and condition can be returned within thirty days of delivery for a refund of the purchase price. Write to Cynthia first. Return postage is yours.

Signed books, books carrying a dedication, and art prints can't be returned.

If something Cynthia has stated about a print turns out to be inaccurate, write to her within thirty days of delivery. She will refund the purchase price when the print comes back in the condition it arrived in, and she covers the return postage.

Refunds are issued to the original payment method and take three to seven business days to appear.

THE ARTWORK AND THE POEMS

Every image and every poem on this site is Cynthia Winter's own work and remains her copyright.

Buying a print means you own that print. It doesn't transfer any rights in the image. Prints and poems may not be reproduced, copied, scanned, published, or used commercially without her written permission.

Nothing on this site may be reproduced for commercial use.

THE NEWSLETTER

Signing up means Cynthia can write to you about new work and upcoming readings. Every email carries an unsubscribe link, and leaving takes one click.

ACCURACY

Cynthia writes and checks everything on this site, but errors happen. Where a price, description, or specification is wrong, she reserves the right to correct it and to cancel and refund any order placed against the error.

Colors vary between screens. A print will not match your monitor exactly.

LIABILITY

Cynthia's liability for any order is limited to what you paid for it.

Nothing here limits any right you have under New York or federal consumer protection law.

THESE TERMS

New York law governs these terms, and any dispute belongs in the courts of New York State.

Cynthia may update this page. The date at the top says when it last changed, and the version in force is the one published when you ordered.
